Indian Lake custodian arrested for allegedly raping student

— New York State Police recently arrested an Indian Lake Central School custodian for allegedly raping a student.

According to a June 13 press release from the State Police, Indian Lake Central School Principal David Snide notified troopers on June 3 about a female student who disclosed that she was having a sexual relationship with an older male. That male was Robert G. Naubereit, 26, of Indian Lake, a full-time custodian at the school.

When contacted about the arrest on June 13, ILCS Superintendent Mark Brand would not reveal the age of the student or the timeline of the relationship. In the release, state police said Nauberiet met the girl after school hours and during his evening shift at the school on several occasions.

"The meetings eventually led to inappropriate conduct by Nauberiet and progressed to him engaging the student in a sexual relationship," the release stated.

State police found Nauberiet at the school on June 3, and he was taken to the Indian Lake State Police Barracks where he was arrested for third-degree rape. Nauberiet was arraigned before Indian Lake Town Justice Thomas Atwell and was remanded to the Hamilton County Jail in lieu of $10,000 bail or $20,000 bond.

Brand said the School Board will be discussing his employment at their June 18 meeting.

"It's a process," Brand said. "We immediately suspended him without pay ... The board is the only one that has the authority to terminate an employee."

When contacted about the incident on June 13, state police investigators said they would not release any more information and that the investigation was ongoing. And Brand said he could not say anything else about the case.

"The district is working with law enforcement and our attorney to resolve this as quickly as possible," Brand said.

According to the New York State Penal Code, a person is guilty of rape in the third degree when:

-He or she engages in sexual intercourse with another person who is incapable of consent by reason of some factor other than being less than 17 years old;

-Being 21 years old or more, he or she engages in sexual intercourse with another person less than 17 years old; or

-He or she engages in sexual intercourse with another person without such person’s consent where such lack of consent is by reason of some factor other than incapacity to consent.

Rape in the third degree is a class E felony.
