To the editor: Comlinks, as managing agent for Peaceful Valley LP is pleased to let everyone in the North Creek/Gore Mountain region know that, Peaceful Valley Townhouses on the Peaceful Valley Road is open, occupied and seeking more families for its 3-bedroom units. The General Contractor, Savarino Construction Corporation of Buffalo, New York, that was hired to build this project on the recommendation of the project co-developer George Hezel of HH Development, Inc. also of Buffalo, was late in delivering the project and has failed to pay a number of sub-contractors and suppliers what they claim to be owed. Despite what Savarino has claimed in area news interviews, Comlinks never fell behind in payments to them. The project was funded during construction with a construction loan from the Community Preservation Corporation (CPC) of Albany, NewYork. Savarinos contract stipulated that they were to be paid on a monthly basis provided that they maintained a lien free project as verified by a title update commissioned by the lender, CPC, at each draw request. Payments 1-13 were made to Savarino on-time, however prior to the approval of pay application 14, a number of mechanics liens were filed by sub-contractors of Savarino for non-payment. Despite numerous requests, Savarino and its bonding company, Cincinnati Insurance Company, failed to remove the liens from the project that total in excess of $590,000. CPC and Comlinks had no choice at that point but to withhold any further payment to Savarino until they remedied the situation that was of their own making. Ultimately, Savarino left the project prior to its completion forcing Comlinks to hire others to finish the project. Savarino has filed a lawsuit against the project owner, Peaceful Valley LP and its affiliates including Comlinks. We are vigorously defending ourselves against this suit which we feel is baseless. Comlinks as managing agent for the project is proud of its association with area businesses who provide services to the project including propane that heats the homes, snow plowing to keep the driveway and walkways clear, septic services and trash hauling for the tenants. We also contract with a number of area businesses for plumbing and heating repairs and other routine maintenance. We have partnered with the Town of Johnsburg who granted the project a PILOT agreement and to whom we pay water taxes as well as contributed $40,000 for refurbishment of one of the Towns wells. We are also proud to continue the mission we began in 5 other Northern New York/Adirondack Towns of providing safe, decent and affordable housing to local working families. Together with our investment partners, the National Equity Fund, CPC and the NYS Division of Housing and Community Renewal, Peaceful Valley Townhouses will remain the first and only affordable housing community for residents of Johnsburg to call home.
