WARRENSBURG A Warrensburg man was charged with driving while intoxicated in an ATV accident on Aug. 23.
Mark Frey, 43, was operating a Suzuki Vinson 500 behind 725 West Mountain Road in Queensbury at about 8 p.m. when the vehicle overturned, injuring his passenger, Rory Birrel, 39, of Queensbury. Birrel was taken to a awaiting Med-Flight helicopter for treatment and evaluation of a head injury.
Frey was charged with operating an ATV while intoxicated, operating an ATV with a passenger, and unregistered ATV. He was released to appear in Queensbury Town Court at a later date.
The accident investigation and arrest were completed by Patrol Officer Michael Anuszew- ski and Patrol Officer Kevin Clark of the Warren County Sheriffs Department.
